INFORMATION CLAUSE CONCERNING VIDEO SURVEILLANCE

SILINGEN POLSKA Sp. z o.o. uses video surveillance on the premises of the workplace to ensure the safety of persons on the premises, protect property, control production processes, keep secret information whose disclosure could expose the employer to damage, and also to protect the environment.

1. Data Controller
   The controller of personal data processed in connection with video surveillance is:

2. Purposes of using surveillance
   Video surveillance is used to:
   • ensure the safety of persons on the premises,
   • protect property,
   • control production processes,
   • keep secret information whose disclosure could expose the employer to damage,
   • protect the environment,
   • establish the circumstances of events and secure evidence if necessary to clarify an event, protect the rights and interests of the Controller, or fulfill obligations arising from legal provisions.
3. Scope and method of using surveillance
   Surveillance covers selected areas of the workplace where its use is justified by the implementation of the indicated purposes.
   Areas covered by surveillance are appropriately marked.
4. Legal basis for data processing
   The legal basis for processing personal data in connection with the use of surveillance is Art. 6(1)(f) GDPR, i.e., the legitimate interest of the Controller, consisting in particular in ensuring the safety of persons, protecting property, controlling production processes, protecting information, and protecting the environment.
   With regard to surveillance applied to employees, the provisions of Article 22² of the Labor Code also apply. The Personal Data Protection Office (UODO) indicates that employee monitoring for these purposes may be based on a legitimate interest under Art. 6(1)(f) GDPR.
5. Retention period of recordings
   Video surveillance is conducted continuously 24 hours a day. Surveillance recordings are stored for a period of 30 days, after which they are automatically overwritten, unless legal provisions require their further retention or the recording has been secured in connection with an event that may constitute evidence in proceedings.
   If further retention of the recording is required or permitted by law, in particular when the recording constitutes evidence in pending proceedings, it may be stored for a period longer than 3 months – until the final conclusion of the proceedings or for a period resulting from applicable legal provisions.
6. Data recipients
   Access to recordings is restricted solely to persons authorized by the Controller, to the extent necessary to perform their duties.
   Recordings may be shared with entities authorized on the basis of legal provisions, in particular the Police, prosecutor's office, courts, and other authorities conducting proceedings.
7. Rights of persons subjected to surveillance
   Persons whose data is processed in connection with surveillance have the rights specified in the GDPR, in particular:
   • the right to access their personal data,
   • the right to obtain a copy of personal data to the extent provided by law,
   • the right to restrict data processing in cases specified in the GDPR,
   • the right to object to data processing under Art. 6(1)(f) GDPR for reasons related to their particular situation,
   • the right to lodge a complaint with the President of the Personal Data Protection Office.
   The exercise of rights may be subject to restrictions resulting from the GDPR and the necessity to protect the rights and freedoms of others.
8. Information about the use of surveillance
   The area covered by surveillance is marked in a way that allows obtaining information about the ongoing surveillance.
